Pennsylvania’s Levels of DUI

In Pennsylvania, DUI charges are divided into one of three main categories: general impairment, high BAC, and highest BAC. To be charged with general impairment, the driver must have a blood alcohol concentration (BAC) of at least 0.08 percent at the time of arrest. High BAC refers to anything between 0.10 and 0.159 percent, while highest BAC involves a blood alcohol concentration of 0.16 percent or above.

The state of Pennsylvania has a very low tolerance for impairment behind the wheel, and sentences offenders accordingly. Those with a BAC of 0.16 percent or higher can expect to pay at least $1,000 and spend a minimum of 72 hours behind bars. With previous DUI offenses, this standard penalty could transform into up to five years in prison.
